Kaohsiung, July 18, 2025 — A Kaohsiung man surnamed Dai filed a lawsuit against a well-known urology clinic after claiming his penis became shorter following an erectile dysfunction (ED) surgery involving a penile implant. Dai, who spent NT$235,000 on the procedure, demanded over NT$500,000 in compensation, but the court ultimately ruled against him.
According to court documents, Dai sought treatment at the clinic two years ago after experiencing erectile difficulties. Upon the doctor’s recommendation, he agreed to undergo penile implant surgery in hopes of restoring his sexual function.
Dai claimed that prior to surgery, his penis measured 18 centimeters when erect and 12.5 centimeters when flaccid. However, three months post-surgery, he noticed that the erect length had decreased to just 12.5 centimeters—the same as its previous flaccid state. Later hospital examinations reportedly showed a further reduction to only 9 centimeters, prompting Dai to question the success of the surgery.
Angered by the outcome, he filed a claim against the clinic, demanding NT$235,000 to recover his surgical expenses and an additional NT$300,000 for emotional distress.
In its defense, the clinic argued that although no pre-surgery photos or measurements were taken, Dai returned for post-operative follow-ups showing no abnormal signs. Medical evaluations conducted in July of the previous year and March this year showed consistent measurements: 12 centimeters from the pubic bone and 9 centimeters from the base of the penis. Furthermore, imaging showed the implant remained properly positioned, indicating the surgery had been performed correctly.
During the trial, Dai presented photos of his genitals to support his claims. However, the judge noted that the photos could not conclusively verify ownership and pointed out that male genitalia can vary in appearance due to factors such as temperature and arousal. Therefore, a specific measurement at one point in time was not considered sufficient evidence of a surgical error.
After reviewing the medical records and scan results, the court concluded that there had been no measurable change in Dai’s penile length since the operation, and the implant had remained in place. With no proof of medical negligence, the judge dismissed Dai’s claims and ruled in favor of the clinic.
